Terms of sale

1. Purpose

These terms govern the sale of paid plans of mdseal. They supplement the terms of use.

Placing an order constitutes acceptance. The customer declares they have capacity to contract.

2. Plans and prices

Plans and their prices are those shown on the Pricing page at the time of the order.

• Prices stated toutes taxes comprises, in euros.
• TVA non applicable, article 293 B du Code général des impôts. La taxe éventuellement due figure sur la facture accessible depuis l’espace du compte.
• The price of an ongoing subscription does not change mid-period. Any change applies to the following period and is announced at least 30 jours in advance.

3. Subscription, renewal, cancellation

• The subscription runs for un mois and renews automatically.
• The customer cancels at any time from their account area, without having to write to anyone. Cancellation takes effect at the end of the current period: the service remains available until then, and no further charge is made.
• No notice period is required, and no penalty is due.

4. Payment

Payments are processed by Stripe Payments Europe, Ltd.. The publisher stores no card data: it never passes through its servers.

If a charge fails, access to paid features is suspended after 7 jours. The account and its data are retained as described in the privacy policy.

5. Delivery

The service is delivered immediately upon payment confirmation.

6. Right of withdrawal

For a consumer entitled to a right of withdrawal, immediate delivery of digital content requires that the customer:

1. expressly requested that performance begin before the end of the withdrawal period; and
2. acknowledged that they thereby lose the right of withdrawal.

Conformément à l’article L221-28 13° du Code de la consommation, ces deux consentements sont recueillis à la commande, par une case à cocher distincte et non pré-cochée, et conservés comme preuve. À défaut de les avoir donnés, le client conserve l’intégralité de son droit de rétractation de quatorze jours.

7. Refunds

Aucun remboursement au prorata n’est pratiqué en cours de période : la résiliation prend effet au terme de la période déjà payée, pendant laquelle le service reste pleinement accessible. Un prélèvement intervenu après une résiliation effective est remboursé intégralement, sur simple demande.

8. Discontinuation

If the service is permanently discontinued, the customer is given at least 60 jours notice and may retrieve their data. Amounts corresponding to the unserved period are refunded.

9. Complaints

Any complaint: drmdh@msn.com. La désignation d’un médiateur de la consommation, requise par l’article L612-1 du Code de la consommation, est en cours. Dans l’intervalle, toute réclamation est traitée directement à l’adresse de contact, et le litige peut être porté devant la juridiction compétente.

10. Governing law

Le présent contrat est régi par le droit français. Le client consommateur conserve le bénéfice des dispositions impératives de la loi de son pays de résidence, qu’aucune clause ne peut écarter.
